What is a Green card in Kenyan Land transactions?

In Kenya, a property Green card is a document found at the Ministry of  Lands and physical planning containing the History of land transactions done on a parcel of land.

The Green card contains the following information:

  1. The date it was opened;
  2. The Registration section;
  3. The parcel number;
  4. The approximate area;
  5. The registry map sheet number;
  6. Nature of Title;
  7. Part A: The Property Section, which contains the information provided under points 1-6 above;
  8. Part B: Proprietorship Section, it provides a history of the owners of the property;
  9. Part C: Encumbrances Section, it provides information on charges, discharges, cautions and mortgages; and
  10. Signature of the issuing registrar at the bottom.

What is the importance of obtaining a Green card as part of the due diligence in property land transactions in Kenya?

We always advise our clients that conducting a search of the property as part of due diligence is not enough, and that a Green card should also be obtained.

A Green card will show a history of all transaction done over the land and the details on the Title Deed should match the Green card if not then the same might be  fraudulent or have some irregularities which must be addressed. 

The Green card proves ownership over the property, hence assures the Purchaser that they are purchasing from the right owner. 

The Green card will protect the purchaser from fraud, as it details all the transactions over the parcel of land, hence ensuring transparency.

How does one apply for a Property Green Card?

In Kenya, application for a Green card, has to be done in writing through the registered owner of the property or professionals like a lawyer or a surveyor.

A letter requesting for a copy of the Green card should be submitted at the relevant lands registry together with the charges.

Once paid, a Green card will be issued. The purchaser should verify the information in the Green card to ensure that it tallies with the Title.
